BMC Issues Showcause Notice to Mithun Chakraborty Regarding Unauthorized Construction in Malad Area.

The Brihanmumbai Municipal Corporation (BMC) has issued a show cause notice to actor and politician Mithun Chakraborty regarding an allegedly unauthorized ground-floor structure located in Erangle village, which falls within the Madh area of Malad. The notice, dated May 10, 2025, was served under Section 351(1A) of the Mumbai Municipal Corporation (MMC) Act.

The BMC is requiring Chakraborty to provide a satisfactory explanation for the construction within seven days of receiving the notice. Failure to provide a sufficient justification could result in the demolition of the structure at Chakraborty's own risk, with the possibility of subsequent legal action.

This action by the BMC is part of a larger initiative targeting illegal constructions in the Madh region. Civic officials have identified a total of 101 unauthorized structures in the area, including bungalows that were reportedly built using forged documents. The BMC has set a deadline to remove all such illegal structures by the end of May.

According to BMC sources, a recent inspection near the Hira Devi Mandir revealed several unauthorized constructions. These include two one-plus-mezzanine-storey buildings, the ground-floor structure in question, and three temporary units. The structures were built using materials such as bricks, wood, glass, and AC sheets, allegedly without obtaining the necessary permissions from the relevant authorities.

BMC officials have stated that these constructions violate Section 475A of the MMC Act, which could lead to penalties and even imprisonment. The notice served to Chakraborty specifically mentions that if he fails to provide sufficient cause, the structure will be removed, altered, or pulled down at his own expense, and he may face prosecution under Section 475A of the Act.

The notice lists the specific unauthorized structures as two ground floor structures with mezzanine floors, and three temporary 10x10 units constructed with brick masonry walls, wooden planks, glass partitions, and AC sheet roofing. The BMC claims that all these constructions were carried out without the required permissions.

Mithun Chakraborty has denied the allegations. In a statement to The Indian Express, he said, "I have no unauthorized structures. The notices have been sent to one and all. We are sending a reply to the BMC."

A similar notice was reportedly issued to Chakraborty in 2011. A local activist from Malad, Nadeem Sheikh, pointed out that the BMC recently conducted a demolition drive in the area but did not take any action against Chakraborty's structure, questioning whether there was differential treatment. On May 13, the BMC demolished 14 illegal structures in Erangal and Valnai areas of Madh, bringing the total to 24 structures razed in two weeks. The BMC has stated its intention to demolish all 101 unauthorized structures identified in the area by the end of May.
